1. About Nerja Home Watch

These Terms & Conditions apply to services booked through the Nerja Home Watch website.

The service provider is:

Liliana Cristina Vasilache, trading as Nerja Home Watch
NIF/NIE: Z2531217A
Address: Calle San Francisco 125, 29780 Nerja, Málaga, Spain

Nerja Home Watch provides scheduled property-check and related auxiliary property conservation and maintenance services.

2. Nature of the Home Watch service

Nerja Home Watch provides scheduled, non-continuous visits to a client's property for the purpose of checking its apparent condition, carrying out agreed simple domestic maintenance actions and reporting visible incidents.

The service is auxiliary in nature. It is not a private security, surveillance, alarm-monitoring or emergency-response service.

It is also not a technical building inspection, professional survey, insurance certification, structural assessment or guarantee that hidden or non-visible defects will be detected.

The detailed scope of any ongoing Home Watch service is set out in the Home Watch Service Agreement provided to the client before the ongoing service begins.

3. The €55 Home Watch Set-up Visit

Before a property can be accepted into an ongoing Home Watch plan, a Home Watch Set-up Visit is required.

The price is €55, including applicable taxes, payable in advance when booking online.

The Set-up Visit includes the initial non-technical inspection of the property, collection or testing of the agreed means of access where applicable, familiarisation with the property, locating its basic systems, recording relevant instructions and preparing the property file.

The visit also allows Nerja Home Watch to determine whether the property can be serviced in an ordinary and safe manner and whether the requested tasks fall within the scope of the Home Watch service.

Payment of the €55 Set-up Visit does not guarantee acceptance of the property into an ongoing Home Watch plan.

4. Property suitability and acceptance

Final acceptance into an ongoing Home Watch service is conditional upon the outcome of the Set-up Visit.

Nerja Home Watch may decline to provide an ongoing service where it reasonably determines that the property is unsuitable. This may include circumstances such as unsafe installations, risks to physical safety, ordinary access being impossible, hazardous materials, work requiring qualified technical professionals, or requested services falling outside the scope of Nerja Home Watch.

If Nerja Home Watch declines the ongoing service following the Set-up Visit, the reason will be communicated to the client in writing and the €55 Set-up Visit fee will be refunded in full, without deduction for the visit already carried out.

No recurring Home Watch fees will then be charged.

5. How online booking works

To book a Set-up Visit through the website, the client:

  1. selects the Home Watch Set-up Visit and an available appointment;

  2. provides the information requested during the booking process;

  3. reviews the service information, price and applicable terms;

  4. provides any required acknowledgements or consents;

  5. makes the €55 payment online; and

  6. receives electronic confirmation of the booking.

The booking involves an obligation to pay €55, including applicable taxes.

Before completing the booking, the client has the opportunity to review the information entered and correct errors using the controls provided during the online booking process.

The booking is made in English through the English-language version of the website. Relevant contractual documentation for the ongoing Home Watch service may be provided in Spanish and English.

Electronic booking and transaction records are retained electronically in accordance with applicable legal, accounting and operational requirements. The client receives confirmation of the booking electronically.

6. Information required after booking

Following the booking, Nerja Home Watch may ask the client to provide additional information required to prepare for the Set-up Visit and, where appropriate, prepare the Home Watch Service Agreement.

The client is responsible for providing information that is accurate and sufficiently complete for the requested service.

Providing false, materially incomplete or misleading information may prevent Nerja Home Watch from performing the visit or accepting the property into ongoing service.

Personal data provided during this process is handled in accordance with the Privacy Policy.

7. Ongoing Home Watch services

The €55 online booking relates to the initial Set-up Visit.

If the property is suitable and the client wishes to proceed with an ongoing Home Watch plan, the terms of that ongoing service — including the selected plan, frequency, price, start date, payment arrangements, access arrangements and other applicable conditions — will be recorded in the separate Home Watch Service Agreement.

The Service Agreement will be provided to the client for review and signature before the ongoing Home Watch service begins.

No recurring Home Watch fee will arise solely from booking the €55 Set-up Visit.

8. Prices and payment

Prices shown to consumers on the Nerja Home Watch website are stated in euros and include applicable taxes unless clearly indicated otherwise.

The Set-up Visit costs €55 including applicable taxes and is paid online at the time of booking.

Available payment methods are displayed during checkout.

No additional optional service or supplement will be charged without the client first being informed of the applicable price and accepting it, subject to any specific provisions concerning urgent and necessary expenses contained in a subsequently signed Service Agreement.

9. Consumer right of withdrawal

Where the client contracts as a consumer and the statutory right of withdrawal applies, the client generally has 14 calendar days to withdraw from a distance contract without giving a reason.

The withdrawal period generally runs from the date on which the service contract is concluded.

To exercise the right of withdrawal, the client must communicate a clear decision to withdraw to:

Nerja Home Watch
Liliana Cristina Vasilache
Calle San Francisco 125, 29780 Nerja, Málaga, Spain
Email: info@nerjahomewatch.com

The client may use the model withdrawal form set out below, although use of the form is not compulsory.

If the client requests that a paid service begin during the 14-day withdrawal period, additional rules apply. Where legally required, Nerja Home Watch will obtain the client's express request for the service to begin during that period and the corresponding acknowledgement concerning the consequences of full performance of the service.

Where a consumer validly withdraws after requesting that performance begin during the withdrawal period but before the service has been fully performed, the consumer may be required to pay the proportionate amount corresponding to the service already provided, where permitted by applicable law.

Where the service has been fully performed during the withdrawal period following the consumer's prior express request and acknowledgement, the right of withdrawal may be lost in accordance with applicable consumer law.

Nothing in these Terms limits any mandatory consumer right.

12. Access and safety

The client must ensure that any access instructions provided are accurate and that Nerja Home Watch can access the property safely and lawfully at the agreed time.

Nerja Home Watch is not required to enter or remain at a property where there is a reasonable concern regarding physical safety, hazardous conditions, unsafe installations or circumstances outside the agreed scope of service.

They may not be reproduced or commercially exploited without the relevant permission, except where permitted by law.

16. Applicable law

These Terms & Conditions are governed by Spanish law.

Where the client is a consumer, any dispute will be dealt with in accordance with the applicable mandatory consumer-protection and jurisdiction rules.

Nothing in these Terms removes or restricts rights that cannot legally be excluded or limited.

17. Relationship with the Home Watch Service Agreement

These Terms & Conditions govern the website and the online booking of the Set-up Visit.

Where the client subsequently enters into an ongoing Home Watch service, that service will additionally be governed by the signed Home Watch Service Agreement and its particular conditions.

Where mandatory consumer law applies, it will prevail over any contractual provision that conflicts with it.
